Terms of Service

Welcome to graffitiCreation. These Terms of Service govern your access to our website, dashboard systems, and purchase of our digital design, development, and marketing services. By hiring us, signing a project contract, or registering an account, you agree to comply with these terms.

1. Project Agreement & Service Scope

We provide digital marketing, custom website development, graphic design, search optimization, and visual shoot services. Each engagement is outlined in a separate scope document or proposal. Any requests outside the agreed scope are subject to additional quotes and timeline extensions.

2. Revisions & Approvals

We include a set number of revision rounds (usually 2-3) in our proposals to ensure you are fully satisfied with the creative deliverables. Revisions must be provided in consolidated feedback documents. Once you sign off on a design phase (e.g., logo concepts or wireframes), subsequent changes to those elements will incur additional design fees.

3. Payments, Deposits, & Cancellations

Clients agree to adhere to the designated payment schedule specified in our invoices:

• Deposits: A non-refundable initial deposit (typically 50%) is required before work begins.
• Balance: The final balance payment is due immediately upon project completion and prior to transfer of source files or live domain deployment.
• Refunds: Once design or coding phases have commenced, payments are non-refundable as they represent allocation of staff resources.
• Delays: If a project is stalled for more than 30 consecutive days due to client delay in providing content, we reserve the right to invoice for work completed.

4. Intellectual Property & File Transfers

Upon final balance payment clearance, graffitiCreation transfers full ownership rights of custom design assets and web code to the client. We retain the right to showcase completed project layouts, screenshots, and logos in our public portfolio and case studies for marketing purposes. Before final payment, all intellectual property remains owned by us.

5. Website Hosting & cPanel Deployments

If requested, we assist in deploying your website code onto your hosting environment (cPanel, cloud VPS, etc.). We are not responsible for host server outages, domain registration lapses, database issues, or security hacks caused by weak client credentials. Clients are advised to maintain active backups.

6. Limitation of Liability

To the maximum extent permitted by law, graffitiCreation shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use our deliverables, including but not limited to loss of revenue, Google search ranking fluctuations, software bugs, or visual campaign performance.

7. Governing Law & Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of India. Any legal disputes arising out of or related to our services shall be subject to the exclusive jurisdiction of the courts located in Noida, Uttar Pradesh.
